A quick reference to the Windsor Trace Farms Covenants, Conditions & Restrictions
Property & Architectural
Residential Use
Lots are for private single-family residential purposes.
Architectural Approval
Plans and specifications are required before constructing or altering a house, building, fence, gazebo, outbuilding, wall, pool, or other structure.
Exterior Materials
At least 80% of the exterior must consist of brick, stone, LP SmartSide siding, or cement-based siding. Foundations must be brick or stone, or extend to ground level.
Home Size
Homes must contain at least 1,600 square feet of heated living space, excluding garages and porches.
Garages
Garages must contain at least 400 square feet and accommodate at least two, but no more than three, motor vehicles. Detached buildings require architectural approval.
Fences & Walls
Fences and walls may not extend closer to the front of the lot than the rear building line and require architectural approval.
Roofs
Primary residential structures require a minimum 8/12 roof pitch.
Storage Tanks
Outside tanks, including propane tanks, must be located behind the front facade and require architectural approval.
Use & Appearance
Animals
Livestock and poultry are prohibited. No more than two generally recognized household pets are permitted. Commercial breeding is prohibited.
Pets Outdoors
Dogs and cats may not be allowed outside unattended, unaccompanied, or off the lot without a fence or another approved method of restraint.
Clotheslines
Outside clotheslines are prohibited.
Home Occupations
Home occupations must comply with Warren County zoning requirements and receive architectural approval.
Signs
Signs are generally prohibited except for one sale or rental sign no larger than eight square feet.
Trash & Outdoor Storage
Trash and rubbish must be kept in enclosed garbage or recycling containers and screened from street view. Unsightly items may not remain on a lot.
Vehicle Repair
Vehicles may not be kept on a lot for repair or reconstruction except for minor repairs or reconstruction.
Outside Appliances
Window air-conditioning units are prohibited. Satellite dishes and antennas are subject to the restrictions contained in the recorded Declaration and applicable federal law.
Lot Maintenance
Owners must keep grass cut, lots free of weeds and trash, and maintain an attractive appearance. Grass on occupied lots may not exceed 10 inches.
Vehicles & Street Parking
Trailers, RVs, Boats & Commercial Vehicles
Trailers, recreational vehicles, buses, boats, motorcycles, motor homes, utility trailers, commercial trucks, and commercial vehicles generally may not be parked or kept on a lot unless housed in a garage or basement.
Temporary Parking
The Declaration contains a limited 24-hour provision for certain vehicles.
Street Parking
All street parking is prohibited except for occasional social events.
Vehicles on Streets
Vehicles other than personal vehicles such as automobiles or pickup trucks may not be parked on any street.
HOA & Enforcement
Membership
Ownership of a lot automatically carries membership in the Windsor Trace Farms Homeowners Association. Membership cannot be separated from lot ownership.
Voting
Class A members have one vote per lot.
Enforcement
The Association or an individual owner may enforce the restrictions through legal or equitable proceedings. The Association may seek an injunction or other legal relief to restrain violations.
Failure to Enforce
Failure to enforce a restriction does not, under the terms of the Declaration, waive the right to enforce that restriction later.
Enforcement Costs
Enforcement expenses, including court costs and attorneys’ fees, may become a charge against the responsible owner’s lot and may be secured by a lien as provided in the Declaration.
Annual Assessments
Annual HOA assessments are due January 31.
Delinquent Assessments
Unpaid assessments bear interest at 10% per year from the due date. The Declaration also provides collection and lien remedies for delinquent assessments.
